These Terms and Conditions ("Terms") govern your access to and use of the Game, including any website, web application, Progressive Web App, Android mobile application distributed via the Google Play Store, and related services we provide. By accessing or using the Game you agree to be bound by these Terms. If you do not agree, do not use the Game.
1.1 The Game is intended for general audiences, including learners of multiplication tables.
1.2 Optional sign-in is provided via Google. By signing in you represent that you are authorised to use the Google account you provide and that doing so does not breach Google's terms.
1.3 If you are under the age of majority in your jurisdiction (18 in Hong Kong), you must obtain the consent of a parent or legal guardian before using the Game, and your parent or guardian agrees to be bound by these Terms on your behalf.
2.1 Subject to your compliance with these Terms, the Company grants you a personal, non-exclusive, non-transferable, revocable licence to access and use the Game for personal, non-commercial educational purposes.
2.2 You shall not (a) copy, modify, distribute, sell, lease, or sublicense any part of the Game; (b) reverse engineer, decompile, or attempt to extract source code, except to the extent such restriction is prohibited by applicable law; (c) use the Game to develop a competing product; (d) interfere with or circumvent any security, rate-limit, or technical measure of the Game or its underlying services (including Firebase Authentication, Cloud Firestore, and Firebase Hosting); or (e) use the Game in any way that violates applicable law.
3.1 All content within the Game — including but not limited to the source code, artwork, character designs (cats, dragons, monsters, heroes), audio, animations, narrative, names, marks, and the "Math Villain" branding — is owned by the Company or its licensors and is protected by the copyright and other intellectual property laws of Hong Kong and other jurisdictions.
3.2 No rights are granted other than the limited licence in Section 2. All rights not expressly granted are reserved.
You agree that you will not:
5.1 The Game stores your progress on your device using browser local storage. If you sign in with Google, your progress is also synchronised to Cloud Firestore so that you can resume on other devices.
5.2 We use reasonable efforts to preserve your progress but do not guarantee that cloud save data will be free of error, loss, or corruption. You acknowledge that browser data may be cleared by you, your browser, or your operating system at any time.
5.3 You may delete your local data by clearing site data in your browser and your cloud data by contacting us at info@bilishadowpaw.com (see the Privacy Policy for details on data subject rights under the Personal Data (Privacy) Ordinance, Cap. 486 ("PDPO")).
6.1 The Game relies on services provided by Google LLC and its affiliates, including Firebase Authentication, Cloud Firestore, Firebase Hosting, and Google Analytics for Firebase. Your use of those services through the Game is subject to the relevant Google terms and privacy notices.
6.2 Payment processing for voluntary support contributions is provided by Stripe, Inc. and its affiliates ("Stripe"). When you choose to make a support contribution, you are redirected to a Stripe-hosted payment page and your payment is subject to Stripe's terms of service and privacy policy (stripe.com/legal). We do not collect or store your payment card details or billing information.
6.3 We are not responsible for the availability, content, or practices of third-party services.
7.1 The Game offers an optional "Buy us a coffee" support feature through which you may make a voluntary one-time contribution of US$7.00 via Stripe. This is a donation to support continued development and operation of the Game.
7.2 Supporter recognition. If you make a support contribution, a permanent "supporter" flag is associated with your account and stored in your cloud-save document. This flag unlocks a cosmetic in-game item (the "TreeGreen" cat character). The supporter flag is a non-monetary recognition only; it confers no ownership interest, equity, or contractual entitlement in the Company or the Game.
7.3 No refunds. Support contributions are voluntary donations and are generally non-refundable. If you believe a contribution was made in error, you may contact us at info@bilishadowpaw.com within 7 days of the transaction. Any refund is at the Company's sole discretion and will be processed through Stripe where available.
7.4 No obligation. The supporter recognition feature may be modified, replaced, or discontinued at any time without notice, and no support contribution obligates the Company to provide any specific feature, content, or service level.
7.5 Regional restrictions. The support feature may not be available in all jurisdictions. It is your responsibility to ensure that making a voluntary contribution through Stripe is lawful in your jurisdiction.
8.1 The Game is delivered as a Progressive Web App and Android mobile application with automatic updates. By using the Game you consent to receiving updated versions automatically.
8.2 We may modify, suspend, or discontinue the Game or any feature at any time, with or without notice. We will not be liable for any such modification, suspension, or discontinuation.
9.1 The Game is provided for entertainment and educational practice. It is not a substitute for formal instruction, professional advice, or any accredited assessment.
9.2 To the maximum extent permitted by applicable law, the Game is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Game will be uninterrupted, secure, or error-free.
10.1 To the maximum extent permitted by applicable law, in no event shall the Company, its directors, employees, contractors, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or game progress, arising out of or related to your use of the Game, whether in contract, tort, or otherwise.
10.2 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the laws of the Hong Kong Special Administrative Region, including liability for death or personal injury caused by negligence and liability for fraud.
10.3 Subject to Section 10.2, the Company's aggregate liability arising out of or related to the Game shall not exceed HK$100.
You agree to indemnify and hold harmless the Company and its officers, employees, and agents from any claim, loss, liability, or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your misuse of the Game, or (c) your violation of any applicable law or third-party right.
12.1 We may suspend or terminate your access to the Game at any time, with or without notice, if we reasonably believe you have breached these Terms or pose a risk to the Game or other users.
12.2 You may stop using the Game at any time. Sections 3, 5.2, 9, 10, 11, 13, and 14 survive termination.
13.1 These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
13.2 You and the Company submit to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region in respect of any dispute arising out of or in connection with these Terms or the Game.
14.1 Entire agreement. These Terms, together with the Privacy Policy and the Personal Information Collection Statement, constitute the entire agreement between you and the Company in respect of the Game.
14.2 Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
14.3 No waiver. Failure to enforce any right is not a waiver of that right.
14.4 Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to any affiliate or successor.
14.5 Contracts (Rights of Third Parties) Ordinance. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) to enforce any of these Terms.
14.6 Changes. We may amend these Terms from time to time. The "Last updated" date will be revised. Continued use of the Game after changes take effect constitutes acceptance.
